Terms and Conditions of Sale

If you do not agree to these terms and conditions, you must cancel your order with us prior to shipping or within 1 business day - whichever is sooner. No restocking fee will be applied to orders canceled within that time frame.

Purchasing

Buyer in the USA certifies that he/she is at least 21 years of age. Buyers in the European Union certifies that he/she is at least 18 years of age. Buyer will have to certify to this on our secure order server prior to placing an order. Further certification may be required at time of delivery. The billing address needs to be the address on your credit card statement. Your billing address is where your order will be shipped. If you wish to ship to an address different than your billing address, please provide this information on your order form.

Orders unpaid 7 days after being placed will be canceled.

Shipping

In the United States, alcohol shipping laws continually change. If at the time of delivery, we are unable to legally deliver wine to you, we will cancel your order and refund 100% of your payment. It is in our sole discretion whether we can legally ship you wine. All wines may be picked up at our Oakland, California facility.

We always recommend shipping to a business address where someone will be present to receive it during business hours. All shipping carriers require an adult signature at the time of delivery. Signature releases are not accepted. If the shipment is returned to us for an improper or incomplete address we will have to re-charge you for re-shipment, so please make sure the address is complete including business name, department or mail stop, if any, and suite number if going to a business complex.

By submitting an order to the JJ Buckley Fine Wines Wines (www.jjbuckley.com) website you are stating that you are 21 years old or older (18 in the EEC), and warrant that you are legally able to purchase and consume alcoholic beverages at your place of delivery. By submitting an order you hereby agree and understand that ALL ALCOHOLIC BEVERAGES ARE SOLD IN CALIFORNIA AND TITLE PASSES TO THE BUYER IN CALIFORNIA.

We make no representation to the legal rights and ability of anyone to ship or import wines into any state outside of California or any country outside the USA. YOU, the buyer, are solely responsible for shipment of alcoholic beverage products. By placing an order for delivery in the USA, you authorize us to act on your behalf to engage a common carrier to deliver your order to you.

ALCOHOLIC BEVERAGES MAY BE SOLD AND DELIVERED ONLY TO PERSONS WHO ARE AT LEAST 21 YEARS OLD AND BY PLACING YOUR ORDER, YOU REPRESENT AND WARRANT TO US THAT YOU ARE AT LEAST 21 YEARS OLD AND THAT THE PERSON TO WHOM DELIVERY WILL BE MADE IS AT LEAST 21 YEARS OLD AND CAN ACCEPT DELIVERY OF ALCOHOLIC BEVERAGES.

When your alcoholic beverages are delivered, the person receiving delivery will be required to show identification proving that he or she is at least 21 years old. If any person under 21 years of age fraudulently orders and has wine shipped to them, the wine will not be released to them, and will be returned to us, and the cost of return shipping will be charged to the responsible party.

BY ORDERING YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE SELLER FOR ANY RESULTING CONSEQUENCE OF A FRAUDULENT ORDER OR ANY MISREPRESENTATION AS TO THE AGE OR LEGAL ABILITY OF ANY INTENDED RECIPIENT TO RECEIVE SHIPMENT OF ALCOHOLIC BEVERAGES.

If you change your order after it is prepared for shipping, we reserve the right to charge for additional handling and packaging materials.

Parents or legal guardians will be held responsible for actions of their minor children. If necessary, legal action will be taken against any and all parties attempting "wire fraud." The cost of shipping to, and returning to us of any wine in any such operation will be charged to that agency. NO EXCEPTIONS.

Future and Pre-Arrival Sales

JJ Buckley sells some wines on a future or pre-arrival basis. Payment for these wines is due at the time of invoicing. Upon arrival of these wines to our warehouse you will be contacted to arrange final delivery to you. At the time you place your order, we may provide an estimated date that we expect the wines to arrive at our warehouse. This date is provided for estimate purposes only - it is not a promise or guarantee of delivery time. We make our best efforts to have your wine arrive in line with these estimates but that does not always happen. Delayed arrival of these wines is not a valid reason to cancel an order.

Further, some wines ordered on a pre-arrival or future basis may not ultimately be available to us. This may occur for a variety of reasons. When we are notified we are not able to obtain a wine, we will refund your full payment to you. We will not be liable for incremental or consequential damages or be required to cover the wine from another source.

For Futures and Pre-arrivals sales, delivery dates are never certain and no sale is made where delivery date is of the essence. Delivery dates provided are estimates only and provided only as guidance. Actual delivery may be later than the original estimate.

Shipping Conditions

JJ Buckley will ship your purchase according to the shipping method you choose. We ship via common carrier and offer ground, 3 day, 2 day and overnight service. Orders generally leave next business day unless an item is sold on a pre-arrival or future or backordered bases.

JJ Buckley Fine Wines reserves the right to hold shipment of your wine during extreme weather conditions. JJ Buckley Fine Wines cannot be responsible for damage to wine (including leakage or damaged corks) shipped to you against our express protestations in regards to weather conditions. Please be aware of the scheduled delivery information, as the date, and location of your delivery cannot be changed once it leaves our warehouse. It is your responsibility to be present when your shipment arrives. If the weather is very hot or cold in your area, and you would like us to postpone our shipping, please advise us. Use the weather in your area as a guide, when making your choice for best shipping method. We do not advise shipping via ground during temperatures over 80°F (26°C) or under 32°F (0°C). We do not advise shipping during temperatures over 90°F (32°C). If you need your order by a specific date, please let us know and we will work with you to try to get the wine to you in time for your needs.

JJ Buckley Fine Wines cannot be responsible for wine damaged by a shipper or inappropriate storage/handling on the part of the shipper. We reserve the right to refuse sales if we deem it to be inappropriate and/or unsafe.

We cannot ship to PO, APO, or FPO box offices. Orders to Alaska or Hawaii must only be shipped 2nd Day Air. Incorrect, insufficient or change of address will incur a $10.00 surcharge. We reserve the right to charge return shipping for refused or undelivered packages. Please allow up to 2 business days for your order to be processed.

International Orders

Shipping for international orders will be quoted by email. All sales made to orders outside the United States are final upon shipment. Absolutely NO RETURNS will be accepted and NO REFUNDS will be provided once the order leaves our warehouse. Product will leave our warehouse in the condition as described prior to the sale - Customer takes all responsibility for damage or loss of wine during shipment.

Errors, Omissions and Availability

Occasionally, our inventory, quantity available, listed prices, or bottle sizes may be incorrect. For example, a 750ml size may be incorrectly priced as a 375ml bottle. Sometimes for matters beyond our control, items sold on a pre-arrival or futures basis may turn out to be unavailable. When such situations occur, JJ Buckley Fine Wines shall be held harmless for the error. We make every effort to make sure that our product database is accurate, however mistakes do happen. In all cases, the customer will be contacted as soon as the problem is discovered. We will promptly return to the customer any monies collected upon discovery of the problem. A refund will be the limit of the remedy.

Returns

All requests for returns or cancellations must be made within 7 days of the invoice date, no exceptions. Because of the fees charged by your credit card company when we charge and subsequently credit your card, we will enforce the collection of our restocking fee if your card has already been charged. We charge your card when your order is reserved for you. If we haven't charged your credit card, you may cancel the order without being subject to our restocking fee. If we have already charged your card, the cancelled processed credit card order for all items - in-stock, prearrivals, futures - shipped or not, are subject to a 15% restocking fee. Please check your order receipt carefully to make sure you ordered the correct wine. We will not be responsible for any incorrect orders placed by you, the customer. Any incorrect orders that are processed and shipped will be subject to a 15% restocking fee, as well as shipping charges back to us if you want to return the item(s). The prices for wine can fluctuate greatly from day to day, because of this we do not accept returns for wines based on price changes within the marketplace.

No returns will be accepted for any product shipped outside the United States.

Special Orders Exception: Items not normally available for sale through JJ Buckley cannot be canceled after 7 days after the invoice date. These are items that we would Special Order to fulfill your order only and we are unable to return them and they are generally unsuitable for resale.

Sales Tax

All wine is sold in the state of California and the title passes to the buyer in California. All purchases shipped to California addresses will be subject to the legally required sales tax.

Our Guarantee

JJ Buckley Fine Wines guarantees quality products and service. Your satisfaction is our first priority. If, for any reason, you are dissatisfied with your order, please contact us within 14 days of the date of your order for customer care assistance. For fastest results, contact us by emailing info@jjbuckley.com. As is tradition in the wine trade, all bottles 10 years or older are purchased at the buyer's risk, and we cannot be responsible for "corked" bottles. BUT if you're not happy with a purchase, please contact us so we can work out an agreeable resolution.

All wine sold by us is maintained at optimum conditions. We consider wine to be out of our control once it has been handed over to the shipper and we cannot be responsible for improper storage after it has been delivered, and as such we cannot accept returns for the following:
Wines that do not coincide with personal tastes.
Wines that have been adversely affected by customer's storage.
Any other adverse condition affected while in customer's care.
You must be 21 and over to purchase and consume wine and alcohol. By using this website, you agree to be bound by the terms and conditions above.

Refer-a-Friend Terms of Service

JJ Buckely's Refer-A-Friend program (RAF Program) is a Qualifying Activity by which you may earn a JJ Buckley $25 Gift Card if a non-JJ Buckley customer you refer makes a purchase with JJ Buckley. You must be a JJ Buckley customer ("JJ Buckley Customer" meaning have made a purchase within the last 12 months) in order to be eligible to earn JJ Buckley Gift Cards through the RAF Program.

To participate, refer friends who are not current JJ Buckley customers and who have never purchased ("New Customer") by sending them an invitation, available on the Site or provided to you as a recipient of an invite-only special offer. If the New Customer, within the 6 months following the referral entry, makes an initial purchase with JJ Buckley priced at twenty five dollars ($25) or more ("Eligible Offer"), JJ Buckley will send an electronic Gift Card of a $25 value, approximately up to 7 days after the Eligible Offer is purchased.

1.         By submitting an entry, you fully and unconditionally agree to and accept these Official Rules.

2.         The sponsor and administrator of this Sweepstakes is JJ Buckley, LLC., 7305 Edgewater Drive, suite D, Oakland CA 94621 ("JJ Buckley" or "Sponsor").

3.         The Sweepstakes is open to all legal residents of the United States, except residents of California, who have reached the age of 18 years old when they enter the Sweepstakes, subject to local laws.

4.         The Sweepstakes is not open to employees, directors and officers of JJ Buckley and those of its affiliated and associated companies, agents, advertising and promotional agencies as well as to the members of their respective immediate families living in the same household. JJ Buckley reserves the right to verify eligibility qualifications of all winners. Void where otherwise prohibited by law.

 

5.         Sweepstakes entries are void where prohibited. All federal, state and local laws and regulations apply. Subject to any governmental approval that may be required, Sponsor reserves the right to, without prior notice and at any time, terminate the Sweepstakes, in whole or in part, or modify Sweepstakes in any way, should any factor interfere with its proper conduct as contemplated by these Official Rules. Sweepstakes will begin on 1/20/13 and end on 2/1/13 at 11:59pm ("Entry Period"). All entries must be received by such time. Receipt of an entry occurs when the participant places his/her entry form online. Sponsor reserves the right in its sole discretion, to cancel the sweepstakes in its entirety, or only the online portion, if it becomes technically corrupted or because of non-authorized human intervention.

6.         Effective date of entries. Entries made online will be effective on the day received. All entries become the exclusive property of JJ Buckley Fine Wines and will not be acknowledged or returned. You are responsible for your costs of entering, including online access charges, long distance telephone charges, and postage.

7.         A random draw will be held on 2/4/13 at 10:00 AM (PST) among the eligible entries. One prize will be awarded as follows: (1) set of (2) Riedel Champagne flutes. Odds of winning are determined by the number of eligible entries received. The winners will be notified by email on or prior to 2/4/13 at 12:00 PM (PST). Each winner must claim his/her prize and return a declaration of eligibility and a liability and publicity release  within one (1) day following the date of the email from JJ Buckley notifying the winner, failing which the prize will be forfeited and awarded to an alternate winner randomly drawn from all eligible entries.

8.         JJ Buckley will not be held responsible for unsuccessful attempts at notifying winners of their win, nor for late, lost or misdirected notifications of wins. If JJ Buckley is unable to communicate with a ed winner, or if a winner does not possess the required eligibility qualifications or does not comply with all the rules and regulations herein specified, the prize(s) will be forfeited and awarded to an alternate winner randomly drawn from all eligible entries.

9.         Any and all applicable local and/or federal, state or provincial taxes (including income and sales taxes) are solely the responsibility of the winner. The prize cannot be redeemed for cash, transferred, assigned or substituted, except that JJ Buckley reserves the right to change or replace the prizes at any time in its sole discretion with prize(s) of greater or comparable value. JJ Buckley will not replace any lost or stolen prize.         

10.       By entering this Sweepstakes, each participant gives JJ Buckley the right to include his/her name, address and other personal information on JJ Buckley mailing list to be used to send participants information and promotional materials regarding the products, services and promotions of JJ Buckley and its various divisions. 11.       By entering this Sweepstakes, each participant grants to JJ Buckley, if he/she wins a prize hereunder, a non-exclusive, worldwide, perpetual, irrevocable license and right to use, display, alter, modify, publish, transmit and prepare derivate works of the participant's photograph, voice, name, hometown, image and likeness in whole or in part, and the participant's creation and pictures featuring the participant's creation in and in connection with the publicity, advertising, exhibiting, marketing, promotion and exploitation of the business of JJ Buckley in any manner and in all media throughout the world without any compensation, consideration or consent.

12.       Automated or robotic entries submitted by individuals or organizations as well as incomplete referral forms will be disqualified. JJ Buckley assumes no responsibility for lost, stolen, mutilated, late, misdirected or ineligible forms. By participating in this Program, each participant agrees to be bound by these rules. JJ BUCKLEY and its parent companies, subsidiaries and affiliates, officers, directors, employees, shareholders and representatives, advertising, and promotional agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of JJ BUCKLEY that may cause the sweepstakes to be disrupted or corrupted; (iv) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney's fees. 14.       In case of dispute as to the identity of any participant who has provided an email address, entry will be d made by the Authorized Account Holder of the email address submitted at time of entry. As used in this Sweepstakes, "Authorized Account Holder" is defined as the natural person who is assigned an email address by an internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide JJ BUCKLEY with proof that such winner is the authorized account holder of the email address associated with the winning entry.

15.       This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook. Each entrant is providing his/her information to JJ Buckley and not to Facebook. By participating in the Sweepstakes each entrant agrees to release and forever discharge Facebook from any and all claims, demands, actions, damages, liabilities, costs, losses and expenses arising out of, or in connection with, the  Sweepstakes.

16.       Choice of law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with the Sweepstakes, will be governed by, and construed in accordance with, the substantive laws of the state of California.

Gift Cards

Gift Card can only be used with JJ Buckley Fine Wines and its recipient will be subject to the terms and conditions of use, local laws and the shipping policy of JJ Buckley in place from time to time. The Gift Cards cannot be redeemed for cash, transferred, assigned or substituted.  Gift Cards cannot be redeemed against shipping, handling and taxes. JJ Buckley will not replace any lost or stolen Gift Cards.
